Crashes in Miami-Dade
Miami-Dade records the highest crash volume of any county in Florida. If police investigated your crash, the report goes to the state and can be obtained through the FLHSMV crash portal; the report is confidential for 60 days but is available to you, your attorney and your insurer immediately.
The 14-day rule is the one that catches people out here: Florida PIP pays no medical benefits at all unless your first treatment happens within 14 days of the crash. Our Florida Personal Injury Claim Timeline guide sets out every deadline that follows.
Arrests in Miami-Dade
An arrest anywhere in the county produces a first appearance before a judge within 24 hours, and most felony cases are then heard at the Gerstein Justice Building. Case records are held by the Miami-Dade Clerk of the Court and Comptroller.
Two things are worth knowing before that first hearing: an arrest is not a charge — the State Attorney decides what to file — and since 1 July 2025 the speedy trial clock runs from the filing of formal charges rather than from arrest.
